Can multiple plaintiffs sue together?

Ningbo is a relevant commercial location for international buyers sourcing from China. Ningbo is a major port and manufacturing center with extensive export-oriented industrial supply chains. A dispute involving a supplier in this market should be considered in light of both the contractual relationship and the practical characteristics of the local supply chain.

Can multiple plaintiffs sue the same defendant at the same time? According to Article 55 of the Civil Procedure Law of the People’s Republic of China, if there are two or more plaintiffs, and the subject matter of the action is the same or of the same kind, the plaintiffs may file a joint action.
There are two scenarios here. The first is that the subject matter is the same, such as in inheritance disputes, joint tort disputes, or partnership debt disputes. In such disputes, the subject matter is likely to be the same, and the court shall consolidate the trials.
The second scenario is that the subject matter is of the same kind, in which case the court may consolidate the trial.
In a joint action, if there are more than ten plaintiffs, two to five plaintiffs may be elected as litigation representatives to participate in the litigation. Legal acts performed by litigation representatives during the proceedings, such as settlement or withdrawal of the lawsuit, shall affect the other represented plaintiffs.
However, Attorney Lyu would like to remind you that there is often a big gap between theory and practice. In many courts in China, the case-filing division does not allow multiple plaintiffs to sue the same defendant together. As for why the case-filing division does so, that is left for you to think about.

Local Supply Chain Risks in Ningbo

International buyers dealing with Ningbo companies may be sourcing products or services connected with machinery, electrical equipment, household products and export manufacturing. Typical issues may include OEM disputes, quality claims, shipping-related disputes, delivery delays and payment disputes. For export transactions connected with Ningbo, buyers should pay particular attention to the contracting entity, product specifications, inspection evidence, shipping arrangements, delivery terms and the allocation of responsibilities under the sales contract.

Ningbo is located in Zhejiang and is supported by a major export ecosystem connected to international shipping and manufacturing supply chains. For cross-border transactions, this background can be useful when assessing supplier verification, contract enforcement and dispute-resolution options.

Resolving a Supplier Dispute in Ningbo

Where a commercial dispute has developed, an overseas buyer should avoid relying solely on informal communications. Reviewing the contract, identifying the correct legal entity, preserving documentary evidence and assessing the available dispute-resolution mechanism are usually important before deciding how to proceed.

The appropriate legal strategy depends on the specific transaction, the supplier’s conduct, the evidence available and the applicable legal framework.
