Attorney Qiang Lyu Teaches You How to File a Report with the Chinese Police

For an overseas buyer, the local business context can matter when dealing with a supplier in Tianjin. Tianjin is a major northern industrial and port city with substantial machinery, equipment and manufacturing activity. The commercial setting should be considered together with the actual contract, supplier identity, goods or services and evidence.

How do you file a report with a Chinese police authority? In China, criminal cases that I frequently handle are difficult to progress without the cooperation of the police authority. Lawyers take clients’retainers with the commitment to act in their best interests. However, lawyers are limited in their right to investigate and obtain evidence before case registration at the Chinese court.

Therefore, in most scenarios, cases are likely to reach a deadlock without assistance from the police authority. Case reporting must be completed in person by the party concerned at a local police station or criminal investigation police team. First, you need a criminal report application and relevant evidence. Evidence is especially critical. The vast majority of individuals fail to prepare supporting evidence properly, which is the primary reason for unsuccessful case filing due to insufficient proof.

Gather all direct evidence: print call logs and chat records with the suspect, save video materials to CDs or storage devices. If witness statements are available, submit the witnesses’ identity information and contact numbers to the police. Financial documents such as invoices and transfer records shall also be handed over to the investigating police officers.
After receiving the application materials, the police authority shall issue a written decision on case filing or non-filing within 30 days in general.

Local Commercial Context in Tianjin

Tianjin has business activity in machinery, automotive, chemicals, equipment and port-related manufacturing. Depending on the transaction, buyers may encounter equipment disputes, quality claims, shipping and delivery disputes, and payment disputes. For machinery, equipment and port-related transactions, buyers should pay particular attention to specifications, inspection records, delivery terms, shipping documents and contractual allocation of responsibility for delays or non-conforming goods.

The city is in Tianjin and has a large industrial base combined with major port and logistics infrastructure. These facts can help explain the commercial background of a transaction, but a legal claim must still be assessed on its own contract, evidence and applicable law.

Next Steps for a Tianjin Supplier Dispute

Before escalating a dispute, an overseas buyer should identify the correct legal entity, review the contract and preserve the available evidence. Depending on the facts, the parties may consider direct negotiation, a formal demand, arbitration, litigation or enforcement.
